Wrongful Termination/Wrongful Dismissal
We zealously represent employers and employees who find themselves entangled in claims involving wrongful termination or retaliation in the workplace. These claims may arise out of the Florida Workers’ Compensation Act, Florida Whistleblower Act, Title VII, the Florida Civil Rights Act, the Fair Labor Standards Act, the Soldier’s and Sailor’s Civil Relief Act and many other state and federal laws.
Harassment/Discrimination
The firm accepts both employer and employee clients for discrimination/harassment lawsuits and administrative proceedings before the EEOC. These include, for example, sexual harassment, sex discrimination, age discrimination, and race discrimination. We are available to counsel our clients in pre-suit matters involving the Equal Employment Opportunity Commission (EEOC) and Florida Commission on Human Rights (FCHR).
Wage and Hour Disputes
The Fair Labor Standards Act and the Florida Constitution require, Florida employers to pay a minimum wage of $8.65/hour and time-and-a-half for overtime (over 40 hours per week) for non-exempt employees. The nuances of these cases can be difficult for the average worker or employer to understand and we stand ready to provide advice or to litigate such matters if necessary.
Non-Compete Agreements
We represent both employers and individuals in various non-compete/non-solicitation matters. We understand Florida’s laws on such topics well, which balance the need for an individual to make a living and the protection of trade secrets and customer contacts. We always work with our clients to reach an amicable resolution of these matters. However, if a negotiated settlement of the dispute is not possible, we are prepared to seek relief from the courts including temporary injunctions, monetary damages and permanent injunctions.
